Transfer of Equity

A transfer of equity is where one person remains on the title register, and others are either added on or taken off.  This is done by correctly completing a TR1 form and registering this with Land Registry.  It can be a delicate time and will need bespoke advice depending on the circumstances.  The team at HS Conveyancing have extensive experience in transfers of equity and will be on hand to provide the right advice for you.

 

Remortgage

A remortgage is where a new mortgage is taken out against your property.  It may require the repayment of an existing mortgage which will be dealt with by us alongside the registration of the new charge at Land Registry.  At HS Conveyancing, we do not only deal with the refinance, we also check your title at the same time to ensure that your title is good and marketable for your new lender.  You will be taken through the process step by step by our specialist team.

Lease extensions

If you own a leasehold property, then it will have been granted for a certain number of years. As most mortgage lenders like to have at least 70 years left on the lease, you may find that it is necessary to extend the term when either looking to sell or refinance.  Our team at HS Conveyancing are on hand to assist with the legal aspect of this process and can either help with obtaining a statutory lease extension, or to guide you through an informal negotiation with the landlord.  Our team are confident in drafting and approving all of the required legal documents meaning that you are in the best possible hands.

 

First Registrations

If a property has been owned for a long time without changing hands or being refinanced, you may find that it is not registered with Land Registry.  If this is the case, then it is necessary to provide a good root of title to Land Registry to prove ownership of at least 15 years. At HS Conveyancing, our team are confident in analysing and constructing paper title deeds to enable the property to be correctly registered at Land Registry.

Declaration of Trusts

If you are looking to buy or Transfer a property, then it is advisable to look at how you can protect your monetary investment to ensure that you get the right return on the sale or refinance of the property.  A Declaration of Trust is commonly used with unmarried couples who are contributing to the purchase of a property in unequal shares, but want to make sure that they get their money back if the relationship breaks down, but they can also be used for just for formalising how you want to hold and share the financial interest in a property.  At HS Conveyancing, we are able to draft bespoke deeds that meet your personal requirements.

 

Shared Ownership

Rectification of Titles

Sometimes it can be apparent that either a Deed has been drafted incorrectly, or further amendments have caused a property title to become defective.  Our knowledgeable team at HS Conveyancing have the ability and understanding to draft applicable documentation to amend and rectify title deeds as and when it becomes necessary to do so.

 

Enfranchisement
